There is a David-and-Goliath struggle going on in Minnesota elections this year. Dan Griffith, Tim Tinglestad and Greg Wersal are running for seats on our state Supreme Court and appellate court. At issue is your right to vote for these positions. On the other side is a group unwilling to see state judges be fairly elected.
Since the Minnesota State Appeals Court was instituted in 1983, governors always have appointed people to appellate court positions despite the fact our state Constitution clearly requires voting on these positions (Art. VI, Sec.7). Through a series of rules that benefit incumbents, appointees are then continuously re-elected. Other qualified legal professionals are intimidated out of running. Dan Griffith, an attorney from International Falls, is risking financial and professional damage to unseat incumbent appointee Judge Larry Stauber of Duluth. Stauber has stated publicly he opposes voting for judges. He refers to this as an "independent judiciary." Does this mean local circuit court judges are not impartial because they have been elected?
