A Virginia man is facing two counts of first-degree criminal sexual conduct involving a child.

Alfonso Carillo Buenaventura, 48, is charged with one count of criminal sexual conduct with a child under age 13 and one count with a child under age 16. The victim is the same in both cases, but the abuse is alleged to have taken place over a period of years.

Buenaventura was booked into the St. Louis County Jail on March 25. Sixth District Judge Robert Friday set Buenaventura's bail at $50,000.

According to the criminal complaint filed March 22 in St. Louis County Court in Virginia:

The victim, who was born in 2005, disclosed to St. Louis County social services that Buenaventura had been having sexual contact with her since she was 5 or 6 years old.

During a forensic interview, the child described how Buenaventura removed her clothing and sexually assaulted her on multiple occasions. She told the interviewer that she believed some of the conduct occurred when she was sleeping because "she would wake up with some of her clothes off," according to the complaint.

The girl also told the interviewer she believed she had been penetrated, the complaint states.

The most recent incident took place on Jan. 18, the victim said. She told the interviewer that Buenaventura "fell asleep" before initiating sexual touching and removing her clothes, the complaint states.

After Buenaventura "woke up," the girl said, they saw a TV commercial about rape, and Buenaventura told her that "it's not rape if someone is sleeping."

The complaint states that Buenaventura was homeless at the time a warrant for his arrest was issued.

Buenaventura's criminal record in Minnesota dates back to 1996. In 2004, Buenaventura faced felony charges of aggravated harassment and stalking of a victim under age 18 and gross misdemeanor charges of making obscene phone calls. The charges were dismissed, but Buenaventura pleaded guilty to a misdemeanor disorderly conduct charge.

Buenaventura is due back in court today for an initial appearance before Judge Michelle Anderson.
