Superior defense attorney Rick Gondik didn't come any closer Tuesday to settling the court case in which he's accused of abusing his 14-year-old son.
Gondik's attorney, Mark Biller of Balsam Lake, Wis., argued in Douglas County Circuit Court that the complaint charging Gondik with felony abuse of a child and disorderly conduct was not properly filed with the court and should be dismissed. Polk County District Attorney Daniel Steffen, appointed special prosecutor in the case, accused the defense of "quibbling" and said any mistakes made in the service of the summons and complaint were harmless errors and the case should go forward.
Because of a variety of procedural errors, the case has twice been dismissed and charges refiled. Tuesday was scheduled to be Gondik's initial appearance on the refiled charges, but the hearing had to be continued.
Sawyer County Circuit Court Judge Gerald Wright gave the prosecution and defense deadlines to submit written arguments in support of their positions and set Sept. 24 as the date to hear oral arguments.
