Prosecutor seeks to try Lincoln Park shooting suspect as an adult

The St. Louis County Attorney's Office will seek to certify Robert Earl McKay III as an adult to face charges that he shot another teenager in July in an apparent dispute over a girl in Lincoln Park/West End.

The St. Louis County Attorney's Office will seek to certify Robert Earl McKay III as an adult to face charges that he shot another teenager in July in an apparent dispute over a girl in Lincoln Park/West End.

McKay, 18, of Green Bay, Wis., was a juvenile at the time of the incident.

McKay is charged in a juvenile delinquency petition with attempted second-degree murder, second-degree assault and possession of a handgun by a person younger than 18 in connection with the July 8 shooting of Jame Scott Keup. The victim survived the gunshot wound to his abdomen.

Under Minnesota juvenile court rules and state law, it is presumed that McKay will be tried as an adult because he was at least 16 at the time of the incident and because of the severity of the alleged offense. A juvenile 16 or older has the burden to prove to the court by clear and convincing evidence that retaining the proceedings in juvenile court serves public safety.

A hearing is scheduled for Jan. 15 before 6th Judicial District Judge Sally Tarnowski.
