Border Patrol agent will stand trial in accident

A state district court judge has ruled that a U.S. Border Patrol agent will proceed to trial on charges in connection with an accident that killed a Cook County man.

A state district court judge has ruled that a U.S. Border Patrol agent will proceed to trial on charges in connection with an accident that killed a Cook County man.

In an order issued Friday, 6th Judicial District Judge Kenneth Sandvik found there was probable cause to indict Maranda Weber on one count of careless driving and one count of failing to drive with due care.

Agent Weber was driving a Border Patrol SUV that struck 67-year-old Kenneth Petersen in October 2007. Petersen was using a chain saw to cut a tree that had

fallen on the road. Weber told authorities that Petersen's vehicle's headlights and those of another car kept her from seeing him in time to stop.

A Cook County grand jury indicted Weber in April 2008. Defense attorney Paul Gogosheske had argued that the evidence presented to the grand jury was insufficient to establish the charges.
