Three area attorneys are being considered to fill a new 6th Judicial District trial court bench vacancy in Duluth.

Michael Cuzzo and John DeSanto, both of Duluth, and Thomas Pertler of Cloquet were recommended for the position by the Commission on Judicial Selection. Gov. Tim Pawlenty announced Friday that he had accepted the nominations.

The position became open after the Minnesota Supreme Court decided to convert a judicial officer position last held by Gerald "Jerry" Maher into a district court judgeship. The state commission received 10 applications for the new vacancy.

Cuzzo has been an attorney and partner with the Duluth law firm of Cuzzo and Envall since 1999 and has been an attorney with several other Duluth law firms since earning his law degree from the University of Minnesota Law School in 1983.

DeSanto is an attorney in private practice in Duluth. He was an assistant St. Louis County attorney in Duluth from 1973 to March 2008 and was chief prosecutor in charge of the criminal division from 1976 to 2007. He earned his law degree from the University of Minnesota Law School in 1973.

Pertler has been Carlton County attorney since 2005 and was an assistant county attorney from 1995 to 2005. Pertler was an associate attorney with two Twin Cities law firms from 1991 to 1995 and earned his law degree from Hamline University School of Law in 1989.
