NOTICE IS HEREBY GIVEN that the Duluth Seaway Port Authority (Authority) is seeking bids for the DSPA EAST ANNEX WAREHOUSE USCBP CARGO INSPECTION FACILITY located at 1120 Port Terminal Drive, Duluth, MN. Bids will be received under the Authority's Purchasing and Contracting Policy and shall emailed to the Duluth Seaway Port Authority, Attention Dean Lembke, Facilities Manager; 802 Garfield Ave., Duluth, MN labeled "DSPA East Annex USCBP Proposal". See below for additional bid submittal information.
This project consists of office, restrooms, break room and equipment storage buildout including electrical, plumbing and HVAC.
Bids will be received until 2:00 pm CST. Tuesday August 31st at which time they will be opened and read aloud.
As per the Duluth Seaway Port Authority (DSPA) purchasing and Contracting Policy Resolution 2-19 Subd. 7, all bids for the DSPA East Annex Warehouse USCBP Cargo Inspection Facility will be received electronically. Scanned copies of the bid bond with a scanned copy of a receipt showing it was delivered to an overnight delivery service must be emailed along with the bid. A contract will not be awarded to a bidder unless its original bid bond is received within three (3) days of the bid opening. Emailed bids and accompanying documents that are not legible may be rejected in accordance with the DSPA purchasing policy. Hand delivered bids will not be accepted. Bids must be emailed to Dean Lembke dlembke@duluthport.com with copies to Kevin Beardsley kbeardsley@duluthport.com and John Erickson JErickson@dsgw.com. To conform to Subd. 9. of the DSPA Purchasing Policy, the bid opening may be attended by interested parties via conference call. The conference line number and access code will be issued via addendum. Attendance will only be allowed via conference call. The conference call will convene at 2:30 p.m. at which time, the bids will opened and read aloud.
A prebid conference meeting will be held on Tuesday August 17th, at 2:00 p.m. on site at 1120 Port Terminal Drive to discuss the scope of the project. NOTE: Due to potential COVID-19 resurgence, this meeting may be set up as an online conference call. To allow for bidders to become familiar with existing conditions site visits to the building may be limited depending on status of any mandates limiting business and travel at that time.
All bids shall be made on the proposal form contained in the specifications and shall be accompanied by a cashier's check, bid bond or certified check payable to the order of the Duluth Seaway Port Authority for not less than five percent (5%) of amount bid as liquidated damages and warranty that the successful bidder will enter into a contract.
This project is funded by the Duluth Seaway Port Authority and is subject to the prevailing wage rates as set forth in the Specifications.
The successful bidder must be a "responsible contractor." The term "responsible contractor" means a contractor as defined in the Minnesota Statutes, section 16C.285, subdivision 3. Any prime contractor, subcontractor, or motor carrier that does not meet the minimum criteria or fails to comply with the verification requirements is not a responsible contractor and is not eligible to be awarded a construction contract for the project or to perform work on the project. A prime contractor, subcontractor, or motor carrier that makes a false statement under oath verifying compliance with the minimum criteria will be ineligible to be awarded a construction contract on the project, and the submission of a false statement may result in termination of a contract awarded to a prime contractor, subcontractor, or motor carrier that submits the false statement. A prime contractor shall include in its verification of compliance a list of all of its first-tier subcontractors that it intends to retain for work on the project. Before execution of a construction contract, a prime contractor shall submit a supplemental verification under oath confirming that all subcontractors and motor carriers that the prime contractor intends to use to perform project work have verified to the prime contractor, through a signed statement under oath by an owner or officer, that they meet the minimum criteria for a responsible contractor.
No Bidder shall modify, withdraw, or cancel his Bid or any part thereof for sixty (60) days after the time designated for the receipt of bids. The Authority reserves the right to reject all bids without explanation and to waive irregularities or to accept such qualifying bids as in the opinion of the Authority will be in the best interests of the Authority. Bidding and awarding of contracts are subject to the provisions of the Duluth Seaway Port Authority Purchasing and Contracting Policy Resolution No. 2-19.
The successful bidder shall furnish performance and payment bonds in the full amount of the contract, and in accordance with Minnesota State Law and Resolution 51-89 of the Authority as required by the Specifications within ten (10) days of receipt of Notice of Award of Contract. There will be Project Labor Agreement for this project.
