NOTICE IS HEREBY GIVEN that the Duluth Seaway Port Authority (Authority) is seeking bids for the DSPA SEAWAY BUILDING SUITES 101 AND 102 BUILDOUT located at 802 Garfield Avenue, Duluth, MN. Bids will be received under the Authority's Purchasing and Contracting Policy and shall be delivered to the Duluth Seaway Port Authority, Attention Dean Lembke, Facilities Manager; 802 Garfield Ave., Duluth, MN labeled "DSPA SEAWAY BUILDING SUITES 101 AND 102 BUILDOUT". See below for additional bid submittal information.
This Project consists of two office buildouts within the Seaway Building located at 802 Garfield Ave, Duluth, MN. These buildouts include but are not limited to plumbing, hvac, electrical, framing, drywall, suspended ceilings, painting and furnishings.
Bids will be received by the Duluth Seaway Port Authority located at 802 Garfield Avenue, Duluth, Minnesota 55802 until 2:00 PM Local Time Wednesday, October 20, 2021, then at said office publicly opened and read aloud. All persons attending the Bid opening must adhere to the Authority's COVID-19 protocols. Visitors to the building must sign in and wear masks for the duration of their visit and comply with any other COVID-19 protocols. NOTE: Due to the potential COVID-19 resurgence, the public opening may be changed to an online conference call.
Each Bid shall be delivered in a sealed envelope indicating the name and address of the Bidder and the name of the Project. Any Bids received after the time set for opening of Bids will be returned to the Bidder unopened. If forwarded by mail, the sealed envelope containing the Bid must be enclosed in another envelope addressed to the Authority at:

An abstract of the amounts of the Bids will be made available to all Bidders after the opening of the Bids.
A prebid conference meeting will be held on Tuesday, October 12, at 1:00 PM on site at 802 Garfield Avenue to discuss the scope of the project. NOTE: Due to potential COVID-19 resurgence, this meeting may be set up as an online conference call. To allow for bidders to become familiar with existing conditions site visits to the building may be limited depending on status of any mandates limiting business and travel at that time.
All bids shall be made on the proposal form contained in the specifications and shall be accompanied by a cashier's check, bid bond or certified check payable to the order of the Duluth Seaway Port Authority for not less than five percent (5%) of amount bid as liquidated damages and warranty that the successful bidder will enter into a contract.
This project is funded by the Duluth Seaway Port Authority and is subject to the prevailing wage rates as set forth in the Specifications.
The successful bidder must be a "responsible contractor." The term "responsible contractor" means a contractor as defined in the Minnesota Statutes, section 16C.285, subdivision 3. Any prime contractor, subcontractor, or motor carrier that does not meet the minimum criteria or fails to comply with the verification requirements is not a responsible contractor and is not eligible to be awarded a construction contract for the project or to perform work on the project. A prime contractor, subcontractor, or motor carrier that makes a false statement under oath verifying compliance with the minimum criteria will be ineligible to be awarded a construction contract on the project, and the submission of a false statement may result in termination of a contract awarded to a prime contractor, subcontractor, or motor carrier that submits the false statement. A prime contractor shall include in its verification of compliance a list of all of its first-tier subcontractors that it intends to retain for work on the project. Before execution of a construction contract, a prime contractor shall submit a supplemental verification under oath confirming that all subcontractors and motor carriers that the prime contractor intends to use to perform project work have verified to the prime contractor, through a signed statement under oath by an owner or officer, that they meet the minimum criteria for a responsible contractor.
No Bidder shall modify, withdraw, or cancel his/her/its Bid or any part thereof for sixty (60) days after the time designated for the receipt of bids. The Authority reserves the right to reject all bids without explanation and to waive irregularities or to accept such qualifying bids as in the opinion of the Authority will be in the best interests of the Authority. Bidding and awarding of contracts are subject to the provisions of the Duluth Seaway Port Authority Purchasing and Contracting Policy Resolution No. 2-19.
The successful bidder shall furnish performance and payment bonds in the full amount of the contract, and in accordance with Minnesota State Law and Resolution 51-89 of the Authority as required by the Specifications within ten (10) days of receipt of Notice of Award of Contract. There will be Project Labor Agreement for this project.
