The court turned away a request by the family of Nancy Toffoloni Benoit to reinstate a jury's decision to make Hustler Magazine pay them almost $20 million. The magazine published the photos after she and her son were killed in 2007 by wrestler Chris Benoit.

In my report to the state auditor, which soon is expected to result in an investigative audit of the Red Plan, I wrote: “The public of Duluth deserves to have reconciliation of these numbers. Public officials continually arguing over the financial numbers of a multimillion-dollar project with no reconciliation is unacceptable governance.”
